ANTHEM LATEST DEVELOPMENTS TWO OBJECTORS APPEAL SETTLEMENT On November 20, 2011, the trial court approved the $90 million settlement, class representative awards, attorneys’ fees and expenses, overruling the three objections that had been filed. Two of the settlement objectors have now filed appeals challenging the Court-approved settlement. It is impossible for Class Counsel to predict how or when the Court of Appeals will rule. Anthem has paid the $90 million into an interest-bearing escrow account, but settlement checks cannot be sent to class members until after the appeals have been resolved, which may take up to two years. In a Settlement Agreement dated June 14, 2012, Anthem agreed to pay $90 Million in cash into a settlement fund that was preliminarily approved by the Court and that will be administered by a Settlement Administrator. COURT GRANTS FINAL APPROVAL OF SETTLEMENT On August 31, 2012, Counsel for Plaintiffs filed a Motion for Final Approval of Settlement, along with supporting documents. On November 20, 2012, the Court entered judgment on the order, dismissing all claims against the Defendants. As a result of the approval of the settlement, Class Members are bound by the terms of the settlement and their rights will be affected by the Release and Discharge provision contained in the Settlement Agreement.
